It is the private expressive association Mission of the Fresh and Alive Private Membership Health Club to share cutting-edge information, education, products, and services to aid members in their efforts to achieve, maintain, or regain their health naturally and non-toxically.

[1] Fresh and Alive Private Membership Health Club, herein known as “FAHC” (pronounced, Fact) or the Club is a Private Sector Private Health Club in which the Members and Proprietor mutually support the Mission of the Club. As a Private Sector Private Health Club, we offer information and guidance pertaining to diet and health programs, products, and services, as well as self-help techniques used to achieve, maintain and regain vibrant health. By joining our Club you agree that your acceptance is your acknowledgement of the terms of this Private Expressive Association Club Membership Agreement.

[2] I enter into this Participation Agreement of my own free will, for myself, on behalf of my dependent minor(s), if any, or as a permanent caretaker of an incapacitated person for whom I am legally responsible, without any pressure or promise of any “diagnosis, prescription for, treatment of, mitigation or cure” of any medical condition. I choose to establish this agreement between myself and FAHC for the express purpose of exchanging information pertaining directly to empowering the achievement of natural health. FAHC agents are not credentialed and are not licensed in any medical, dental, or other healthcare professions. FAHC Private Members consult their own medical, dental, healthcare, etc. professionals, practitioners, etc. for advice.

[3] FAHC declares one of our primary objectives is to maintain and improve the religious and civil rights, constitutional guarantees, and political freedom of every member throughout the world who chooses to participate in our Club. For US citizens and residents,  we believe the First Amendment of the Constitution of the United States of America guarantees our members the right to free speech, petition, assembly (acknowledged collectively by the United States Supreme Court as “expressive association”) for the lawful purpose of advising and helping one another to achieve, maintain and regain good health by asserting our rights under the Federal and State Constitutions and Statutes. It is hereby declared that we, as a Private Sector Private Health Club are exercising our right of “Freedom of Assembly” as guaranteed by both the 1st and 14th Amendments of the U.S Constitution and the equivalent provisions of the various State Declarations. This means any activities through or within FAHC are restricted to that of the Private Domain only. Further, the application of any learned techniques intended to remedy my personal health considerations without a medical doctor’s approval is also of my own free will and is considered an act of exercising my Constitutional Rights.

[4] I hereby give Informed Consent and privately license the individuals of the FAHC Team to provide the private information and services that I may from time to time request. I understand that public licensing laws do not apply to private activities in private associations. I hereby indemnify and hold harmless FAHC and the FAHC Team from all liability for the use or abuse of what I may learn as a Member.

[5] I attest that my actions on this and any subsequent visit to the to the website (including electronic communications) are solely of my own behalf and not as an agent or representative for any federal, state, or local agency, whose purpose is to regulate and approve products, or to carry out entrapment or investigation. My activities within the Club are considered a private matter that I refuse to share with any public entity(ies)/corporation(s)/organization(s)/platforms including but not limited to, government(s), government contractor(s)/ agent(s)/ employee(s)/ personnel, State or Federal Regulatory Board, the US Food and Drug Administration, US Federal Trade Commission, Medicaid, hospital(s), medical center(s), clinic(s), doctor(s)/other licensed medical/healthcare/other professional(s), insurance company(ies), conventional medicine company(ies), or the “Internet of Things,” without express written permission from FAHC. All records or documents remain the property of FAHC, even when I retain a copy. Because the privacy and security of records maintained within FAHC are strictly protected, documentation will only be released when requested in writing personally from the participant. I agree to waive all HIPAA privacy rights and complaint processes, and understand that FAHC does not participate in medical insurance plans, or collections on behalf of any member.

[6] FAHC forms, tenets, membership contract, flyers, brochures, articles, labels, publications, website material, presentations, lectures, broadcasts, recordings, processes, etc. are copyrighted by FAHC and may not be copied, reproduced, published, broadcast, rewritten, shared, distributed, incorporated into anything, etc. in any way without express written permission from FAHC, which may be withheld at FAHC’s discretion..

[7] Representatives of FAHC who provide services or information do so as private health guidance coaches and not in the capacity of licensed health care providers. I understand that no ‘doctor-patient’ relationship exists; rather an at-will educational and empowering mutual relationship is intended. I understand it is my own responsibility to consider the advice and recommendations offered to me by any of the FAHC team, and to educate myself as to the efficacy, risks and desirability of any information provided. I understand that I should consult my primary health care provider if I suspect any medical condition.

[8] I willingly provide representatives of the Club permission to discuss openly and freely my personal health concerns, as well as solutions to these issues, among themselves and with me. Any information shared by representatives of FAHC including (but not limited to) diet, nutritional, herbal, homeopathic, fasting, or any other health information, is solely for educational purposes only and does not involve or include diagnosing, prognosticating, treatment, or prescribing of remedies for the treatment of diseases and should not be considered a substitute for medically necessary diagnostics.

[9] I fully agree to hold harmless any member or representative of FAHC with whom I communicate in any manner. I assume total responsibility and liability for my actions, safety, health, and use of FAHC information, products, or services, as well as for those whom I choose to give or share FAHC information, products, or services.I agree not to file a malpractice lawsuit against a fellow member of FAHC, unless that member has exposed me to a clear and present danger of substantive evil. I further acknowledge that members of FAHC do not carry malpractice insurance. I agree that violation of any terms or clauses within this agreement will result in a no-contest legal proceeding against me.

[10] I understand that I can withdraw from this Agreement and terminate my participation at any time. If I engage in abusive, violent, menacing, destructive, or harassing behavior towards any other team-member or other participant of this Private Sector Private Health Club, my membership will be dismissed, and access to all services will cease.

[11] For good and valuable consideration of US $5.00, the exchange whereof is hereby acknowledged, this Agreement is intended to, and does hereby establish a private mutual trust relationship with the Proprietor, Club, Team, and other Members. I have freely chosen to change my legal status as a public citizen to a Private Member, and respect the private nature and confidentiality of FAHC.I recognize my signature upon this agreement entitles me to access to benefits provided by the Club for the life of the Club, beyond those associated with the Freedom of Assembly, and those Protections and Civil Rights the United States Constitution provides. Membership provides exclusive access to educational information, advisory services, recommendations, and educational materials including text, video, audio, and other formats. I understand I will continue to be bound for my lifetime in honoring the privacy and confidentiality as stated herein; and that the term of membership starts at the signing of this agreement and continues until terminated by both parties in writing.

[12] I hereby agree with the Proprietor, Club, Team and other Members that all disputes arising under this Agreement, or among the Proprietor, Club, Team and other Members, shall be subject to voluntary mediation and conflict resolution, and any party may refer any dispute to binding arbitration under the auspices and rules of the American Arbitration Association, or other mutually agreeable arbitrator, in the headquarters City of the Club. The final decision of the arbitrator may be enforced in any tribunal of competent jurisdiction.

[13] I hereby agree to, and digitally sign this Agreement, without coercion, in exchange for access to the benefits of the Private Health Club. By clicking “I agree” at the time of creating my membership, I acknowledge that I have read, understand and agree to the above stated terms.
